Michael Rafferty was convicted of first degree murder, kidnapping, and sexual assault. Automatic life sentence. Sometimes there is justice in the courts.

Indeed!

The judge made a choice not to admit evidence obtained by police in a less than legal search which resulted in a lot of criticism from Canadian press and people. However, I support the judges decision.

Evidence of Rafferty looking up child-pornography, and searching sick things like child rape was not admitted to court because, when police searched Rafferty’s car they did not have a warrant specifically for his computer or cellular phone.

A lot of people have been up in arms about the fact that the jury did not have this information at their disposal while considering a verdict. I for one am not one of those people and here is why:

Rafferty and McKlintock are sick people who will never get better, who given the chance, would re-offend. If I were a judge, fuck impartiality- I would want to make sure I did everything within my power to make sure the sick fuck who molested and killed a child would never, ever get a chance at a new trial. By not allowing the evidence into court, the judge eliminated the one tiny shred of a chance Rafferty could have had to get away with his crimes- appealing based on procedural misconduct. To me that was the smartest decision that could have been made. It was the most concrete way to make the case, from a procedural standpoint, as possible.

Rafferty doesn’t deserve a chance to get away with murder. He wasn’t given one today, and we have a really smart judge and a great jury to thank for that.
